
Former President Joe Biden has filed a lawsuit against the Trump Justice Department in an effort to prevent the release of audio recordings tied to Special Counsel Robert Hur’s investigation into Biden’s handling of classified documents. The legal filing comes as the Department of Justice is reportedly preparing to provide recordings and transcripts to Republican lawmakers and outside organizations seeking access to the material.
The recordings stem from approximately 70 hours of conversations Biden held with ghostwriter Mark Zwonitzer in 2016 and 2017 while working on his memoir, Promise Me, Dad. The discussions, which took place in Biden’s home, later became part of Hur’s investigation after questions emerged regarding classified material referenced during the sessions.

Special Counsel Robert Hur ultimately declined to recommend criminal charges against Biden, though his report generated significant political attention after describing Biden as an “elderly man with a poor memory.” The report became a major issue during the 2024 election cycle and fueled ongoing public debate surrounding Biden’s age and mental sharpness while in office.
According to court filings and Hur’s report, some recordings allegedly captured Biden discussing classified information and reading portions of sensitive material aloud. Investigators also examined deleted audio files connected to the project, though authorities later recovered the recordings during the course of the investigation.
Biden’s legal team argues that releasing the tapes would violate privacy protections involving personal conversations conducted inside a private residence. Attorneys for the former president stated that individuals, including current and former elected officials, retain privacy rights regarding personal communications collected during criminal investigations.
President Donald Trump reacted publicly to the lawsuit, criticizing Biden’s effort to block the release of the material. Meanwhile, the broader controversy continues to draw attention as legal, political, and media battles surrounding the classified documents investigation remain active.
