The US Department of Justice announced that former FBI Director James Comey has been indicted again, according to reports citing sources familiar with the case.
The latest indictment is tied to a social media post Comey shared nearly a year earlier while on vacation. The case has drawn renewed attention due to its unusual origin and legal implications.
The post in question appeared on Instagram and featured seashells arranged to form the numbers “86 47,” accompanied by a caption describing the scene as a beach discovery.
After the image gained widespread attention, Comey deleted the post the same day. He later explained that he had not intended to convey any harmful meaning.
In a follow-up statement, Comey said he was unaware that some people interpret those numbers as references associated with violence. He emphasized that he opposes violence and removed the post once concerns were raised.
At the time, officials within the administration viewed the image differently. Some interpreted the numbers as a coded message referencing Donald Trump, who is also the 47th president.
The slang term “86” can sometimes be used to mean removing or eliminating something, which contributed to concerns among government officials reviewing the post.
Then–Homeland Security Secretary Kristi Noem stated that her department, along with the Secret Service, was looking into the matter to determine whether it posed any credible threat.
This marks the second time Comey has faced federal charges within the past year. A previous indictment was filed in 2025 related to statements he made before Congress.
That earlier case involved testimony before the Senate Judiciary Committee concerning issues tied to FBI investigations and internal communications.
Prosecutors at the time charged Comey with making false statements and obstructing a congressional proceeding under federal law.
However, a federal judge later dismissed that indictment. The ruling focused on procedural issues involving the appointment of the prosecutor who brought the case.
The dismissal was issued without prejudice, meaning the government retained the option to refile charges if proper procedures were followed.
The new indictment now shifts attention back to Comey’s actions and raises questions about how public statements by former officials are interpreted and evaluated.
As legal proceedings move forward, the case is expected to draw continued scrutiny, particularly given Comey’s high-profile role in past federal investigations and public life.
